THE EFFECTIVENESS OF THE CRIMINAL LAW: THE EVOLUTION OF RESEARCH, WAYS TO SOLVE PROBLEMS

Abstract
As a result of the assessment, the available studies of the effectiveness of various criminal law phenomenarevealed unacceptable ones (ignoring goals, qualitative indicators, etc.). and progressive provisions to be usedin the study of the effectiveness of any legal phenomena. Methods of economic analysis, for example, areof interest to researchers of criminal law from the standpoint of the economic state of society, to determinethe facet of criminal-criminal in economic crimes, to predict the effectiveness of criminal law. The use ofAI complements traditional ways of assessing the effectiveness of legal phenomena with modern tools andnew methods for calculating quantitative indicators. It is also concluded that to date, the institute of theeffectiveness of the criminal law has not been sufficiently studied: many issues are debatable, others have notbeen noticed or evaluated; the disparity of research on various aspects, levels of effectiveness of the criminallaw, law, and its structural elements is obvious. A complete picture of the effectiveness of the criminal law canbe provided by a study of effectiveness in relation to each and every element of it: the overall effectiveness ofthe criminal law, institution, group of norms, corpus delicti, punishment; disposition, sanctions; in relation to the qualitative and quantitative side of this institution; at all stages of life norms (justifications of the criminallaw): lawmaking, implementation — application, execution (criminalization, penalization, etc.). They are notthe same for different levels of research on the effectiveness of the criminal law, they are specific at each stage
