THE CONSTRUCTION OF “LEGAL CERTAINTY” IN THE CONCEPTUAL-CATEGORICAL APPARATUS OF CIVIL PROCEDURAL LAW OF RUSSIA

Abstract
The article explores the place of construction “legal certainty” in the conceptual-categorical apparatusof civil procedure law of Russia. The author analyzes the difficulties of interpretation and application of thecategory of “legal certainty” due to the relative novelty of the use of this concept in terminological circulation,which was put into active terminological circulation in connection with the ratification of the Convention forthe Protection of Human Rights and Fundamental Freedoms and the adoption of numerous rulings of theEuropean Court of Rights in relation to Russia person. The author suggests identifying three independentforms of perception and the existence in Russia of new procedural and legal phenomena: 1) a normative(legislative) form; 2) non-normative (judicial) form; 3) doctrinal form. Based on the study of the regulatoryframework, law enforcement practice, the construction of “legal certainty” is assigned to the second group.Since at the moment there is no legislative consolidation, however, its interpretation and interpretation iscontained in judicial practice: court decisions and decisions, as a rule, of the highest judicial instances.
