YATROGENNY CRIMES AS NEW TYPE OF CRIME IN CRIMINAL LAW OF THE RUSSIAN FEDERATION

Abstract
The present article is devoted to current problems of yatrogenny crime in the context of moderndomestic social and legal reality. The yatrogennykh of events often the careless actions of health workerscaused by criminal negligence or criminal levity are the reason. Need of formation of modern criminalpolicy and the effective mechanism of its providing mediates expediency of theoretical justification ofa complex of preventive measures of the legal, social, economic character called to prevent yatrogennycrimes. The analysis of the existing legal positions allows to track further research prospects of thisproblem. The real research comprises the list of articles of the Criminal code of the Russian Federationunder which health workers are brought to trial and also offers on introduction of separate article whichwould provide responsibility of health workers. The materials of judicial practice opening an essence theyatrogennykh of crimes which analysis shows that it obviously lacks deep theoretical base for criminal andcriminalistic assessment of crimes, difficult and hardly demonstrable owing to the specifics, are presentedin article.
